These Terms of Service ("Terms") govern your use of the website and services operated by Zach S (the operator), doing business as Local Launch. Zach S, operating as Local Launch, is a Greenville, South Carolina based provider of website design, local SEO, and digital marketing services for small businesses. By accessing or using our website or service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Local Launch provides website design, local search engine optimization (SEO), Google Business Profile optimization, AI receptionist, and related digital marketing services for small businesses in Greenville, SC and the Upstate South Carolina area.

2. Use of the Website

• You may use our website for lawful purposes only and in a manner that does not infringe the rights of others.
• You agree not to misuse the website, attempt to gain unauthorized access, or disrupt its operation.
• Information you submit through our forms is subject to our Privacy Policy.

3. Text Messaging (SMS/MMS)

By opting in to text messaging, you consent to receive text messages from Local Launch at the mobile number you provide. Message frequency varies. Message and data rates may apply.

• Opt out: Reply STOP to any message to stop receiving text messages.
• Help: Reply HELP to any message to receive assistance.
• Consent to receive text messages is not a condition of purchasing any goods or services.
• We are not responsible for failed or delayed message delivery caused by your carrier or device.

4. Payments & Billing

• Service pricing is quoted before work begins. Some services are one-time builds; others are billed monthly for ongoing maintenance, SEO, or retainers.
• Invoices are due as stated on the invoice. Work may be paused if an invoice remains unpaid.
• Prices are subject to change, but changes apply only to new engagements unless otherwise agreed.
• Deposits and payments made before work begins are non-refundable once work has started. Monthly services are billed as rendered and are non-refundable for the month in which they are provided. You may cancel monthly services at any time; cancellation takes effect at the end of the current billing period.

5. Refunds

• Because custom website builds and digital marketing work are delivered services, all payments are non-refundable except as required by law.
• If Local Launch fails to deliver the agreed-upon deliverables within the stated timeline, we will work to correct the issue promptly or issue a pro-rata refund for the undelivered portion.
• For monthly services, you may cancel anytime; you are not charged beyond the current billing period.

6. Client Content & Ownership

• You retain ownership of content, logos, photos, and materials you provide to us.
• We may use completed work as a portfolio sample unless you request otherwise.
• Any third-party assets (images, fonts, software) are licensed to us or to you as applicable.

7. Intellectual Property

All website designs, code, content, logos, and materials we create for you become yours upon full payment, except for our pre-existing tools, frameworks, and licensed third-party assets. Our website and its original content are our intellectual property.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific search engine rankings, traffic, or business results.

9. Limitation of Liability

To the maximum extent permitted by law, Local Launch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Local Launch and its personnel from any claims, damages, or expenses arising from your content, your use of the Service, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may cancel services per your agreed engagement terms; SMS opt-out is available at any time by replying STOP.

12. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Greenville County, South Carolina.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.
